The Attorney General’s Office seeks an experienced attorney to join its Tax Litigation Division which is housed in the Solicitor General’s Section of the Office. The attorney’s primary caseload will involve representing the Minnesota Department of Revenue in tax protests filed with the Minnesota Tax Court, a specialized court with the jurisdiction to hear and determine matters related to Minnesota’s tax laws. The position will also include appellate work arising out of the decisions of the Minnesota Tax Court, which are immediately appealable as a matter of right to the Minnesota Supreme Court. The Tax Litigation Division of the Office also represents the Minnesota Department of Revenue and other state agencies in bankruptcy courts throughout the country.
Responsibilities: The successful applicant will litigate tax cases before the Minnesota Tax Court. In this position, the lawyer will act as lead counsel in all phases of assigned cases, including pleadings, discovery, and trial with minimal oversight. In addition, the successful applicant will assist and support other attorneys in the division on cases requiring more than one attorney.
Qualifications: Graduation from a law school accredited by the ABA and licensed to practice in the State of Minnesota;
o Three years of complex civil litigation experience;
o An interest in handling cases involving complex statutory schemes;
o An interest in appellate work; o Excellent research and writing skills;
o Proven ability to litigate autonomously and to make strategic legal decisions as lead counsel on a caseload involving different tax types;
o Proven ability to counsel and advise clients throughout all stages of a case;
o Ability to travel to counties throughout the state;
o Experience using electronic files, case management tools, and e-discovery platforms;
o Proven ability to contribute positively to a team and interact successfully with clients and members of the public;
o Proven ability to multitask by managing an active caseload and meeting tight deadlines; and
o Proven ability to work in an inclusive, creative, and collaborative work environment.
Preferred Qualifications:
o Five or more years of complex litigation experience, including the use of experts at trial;
o Knowledge of state and federal tax laws or a proven track record of handling cases that implicate complex statutory schemes;
o Knowledge of the Bankruptcy Code; and
o Appellate experience, including drafting briefs and arguing before appellate courts or an appellate clerkship.
