The Attorney General’s Office (AGO) is seeking an attorney with an interest in Minnesota’s Government Data Practices Act and at least 1 year of civil litigation experience or equivalent, to join our eDiscovery and Litigation Support Division. The successful candidate will serve as the AGO’s Data Practices Compliance Official (DPCO), as defined in the Minnesota Government Data Practices Act (MGDPA) and Minnesota Rules, chapter 1205. As the DPCO, the attorney will handle and process all data requests as well as litigate data practices disputes. This is an exciting opportunity for a qualified professional to join a highly committed team that handles important eDiscovery and litigation support for the AGO.

This position develops and coordinates the AGO’s data practices program and policies. The DPCO is responsible for reviewing and holding in confidence highly sensitive information and materials. Moreover, the applicant must be prepared to handle any litigation related to data practices disputes on behalf of the AGO. The DPCO uses technology daily and must be comfortable learning and using technology to search, export, review, and respond to data requests.

A successful candidate will have the opportunity to support the mission of the office by:

  • Serving as the dedicated contact for all data practices requests and questions from AGO staff and the public
  • Assessing the merits and scope of requests; searching and exporting data from AGO systems; reviewing, classifying, and redacting data; tracking data requests; and responding to each data request (this position performs most of the document review)
  • Representing the AGO and agency clients on data practice disputes
  • Coordinating with AGO colleagues on collection of data responsive to requests
  • Serving as coordinator for the AGO’s advisory Data Practices Council
  • Developing training for AGO staff on their responsibilities under the MGDPA, Official Records Act, and relevant AGO policies
  • Serving as subject matter expert on the AGO’s records retention schedule
  • Convening and contributing to internal meetings where leaders make decisions about challenging issues regarding our data and how best to manage, secure, and disseminate it appropriately
  • Performing other projects or assignments

Minimum Qualifications

  • Graduation from a law school accredited by the ABA
  • Licensed to practice in the State of Minnesota or ability to obtain licensures within 90 days of hire
  • One year of civil litigation experience or equivalent
  • Highly attentive to detail and demonstrated ability to handle highly sensitive information
  • Strong research, analytical, written, and oral communication skills (a cover letter with a writing sample is required with application submission)
  • Demonstrated high level of experience with modern office hardware and software
  • Good judgement of character and a strong professional work ethic

To be considered at the S2 level, candidates must have 6 years of related experience.  To be considered at the S3 level, candidates must have 12 years of related experience.

Preferred Qualifications

  • At least one (1) year of experience as a specifically designated DPCO for a Minnesota government entity.
  • Demonstrated experience:
    • developing and delivering trainings on issues including or related to data practices compliance to government officials
    • searching and exporting data and loading data into document review platforms
    • researching the nature of data classified as public or not public
    • with broader principles of data governance, including data retention and official records
    • developing statutory changes and testifying before the legislature.
